UP-RERA Enables Online Complaints Against Illegal Transfer Charges

The UP Real Estate Regulatory Authority (UPRERA) has launched an online complaint mechanism for homebuyers and allottees to challenge unlawful transfer charges imposed by developers during property transfers.

Key Features of the Online Complaint System

  • Easy Online Filing: Homebuyers can file complaints through the UPRERA portal using the e-court system.
  • Form-M Filing: Complaints can be filed using Form-M.
  • Maximum Processing Fee: Developers can charge up to ₹1,000 for transfers within family, ₹1,000 for transfers between family members, and ₹25,000 for transfers to non-family members.
  • Documentation Required: Succession certificates, death certificates, and NOCs from legal heirs are required for inheritance-related transfers.

Benefits of the Digital Complaint System

The digital complaint system aims to curb arbitrary charges, which in some cases reportedly ran into lakhs of rupees, creating financial stress and delays in property transfers.

How to File a Complaint

  1. Login and Registration: Log into the UPRERA portal at up-rera.in and select e-Court login/sign-up.
  2. Filling Form-M: Fill in Form-M and choose "Unlawful Transfer Charges" under complaint grounds.
  3. Uploading Documents: Upload supporting documents.
  4. Paying Fee: Pay a ₹1,000 fee.

Experts have welcomed the move, calling it a step towards greater transparency and accountability.
